Winter and Aaron Scheinfeld may have thought as they were trying to find a qualified replacement for a sick secretary, to no avail, back in 1948.<\/p>\n<p>As they realised that they probably weren\u2019t the only ones that were grappling with such problems, in the very same year, they founded the company Manpower Inc. in Milwaukee, USA. The idea became established and the new sector of modern temporary employment took off on its huge triumphal course across the USA in the following years. The unstoppable expansion in the United States proceeded in Europe with the opening of two offices in Paris and London in 1956.<\/p>\n<p><strong>Employment Agency Act<br \/><\/strong>The history of temporary employment in Germany goes back to the era after World War II. The placement of workers in return for money is regulated for the first time by the 1922 Employment Agency Cct. Parts of it were adopted in the new Job Placement and Unemployment Insurance Act, in short AVAVG, on 16 July 1927. An emergency decree by the Reich President on as early as 6 October 1931 put the burden of the full employer obligations on the placement agencies. Due to the reign of the National Socialists in the Third Reich, all placement activities of this sector became an unrestricted monopoly on 5 November 1935. Temporary employment at that time was thus all but dead.<\/p>\n<p><strong>AVAG (Recognition and Enforcement Implementation Law)<br \/><\/strong>It wasn\u2019t until years after the end of this terror regime, after the so-called Federal Agency for Job Placement and Unemployment Insurance had been founded on 10 March 1952, when the regulations of the AVAVG dated 1927 became effective again. Yet understandably, the Germans had other worries at that time rather than adopting, further developing and modernising good ideas of times gone by.<\/p>\n<p><strong>Placement monopoly<br \/><\/strong>In the meantime, the expansion of temporary employment had also secured Europe. The pioneer of modern-time temporary employment was the Swiss company ADIA Interim, which set up a branch in Hamburg in 1962. The work of ADIA \u2013 Interim immediately attracted the attention of the Federal Employment Agency, how could it be otherwise, who saw their placement monopoly at risk and filed a complaint. The test case went through all levels of jurisdiction. On 4 April 1967, the Federal Constitutional Court in Karlsruhe passed the judgement: The expansion of the employment placement monopoly to temporary employment contracts via Section 37 AVAVG is not compatible with the basic right of free choice of employment as defined by Section 12 of the German Constitution.<\/p>\n<p><strong>Minimum protection<br \/><\/strong>The triumphal procession of the service \u201ctemporary employment\u201d then also began in Germany. In order to ensure the minimum social protection of temporary workers as called for by the Federal Social Court in a judgement in 1970, the law on the regulation of the supply of temporary workers (the German Law on Labour Leasing \u2013 in short A\u00dcG) was passed in 1972 and also came into effect. With the introduction of this law, the legislator pursues various objectives:<\/p>\n<ul>\n<li>To make the operating of temporary employment agencies dependent on a licence<\/li>\n<li>To distinguish the temporary employment agencies from employment agencies<\/li>\n<li>To prohibit the long-term supply of temporary workers<\/li>\n<li>To subject the supply of temporary workers to state monitoring<\/li>\n<li>To ensure the protection of temporary workers under employment and social security laws<\/li>\n<li>To guarantee special protection for foreign workers.<\/li>\n<\/ul>\n<p><strong>Black sheep<br \/><\/strong>At the same time as the passing of the A\u00dcG, the Federal Government was commissioned to produce a report every four years on the experiences with the application of this law. Unfortunately, even this young, highly promising and modern sector was not spared ruthless racketeers. Black sheep did not pay any attention to the regulations employers had and social matters of course. The cases uncovered were included in the field reports by the Federal Government. This resulted in the prohibition to supply temporary workers to the main construction trades, because that was where the most violations were registered back then. On 01 January 1982, \u201cthe supply of temporary workers to businesses in the construction trades for work that is usually performed by workers\u201d was prohibited by law. A complaint of unconstitutionality directed against this was unsuccessful as per the judgement of February 1988.<\/p>\n<p><strong>Amendments<br \/><\/strong>Various amendments to the A\u00dcG have been made since then. Even temporary employment has to constantly adapt to changing markets and conditions. Particularly in the course of the \u201cHartz proposals\u201d, the framework conditions for the supply of temporary workers have been changed significantly. Since 01 January 2004, for example, there has been no limitation on the longest duration of leasing anymore; the prohibition of synchronisation and the re-employment band have been abolished. In parallel to this, the non-discrimination precept of the temporary workforce with the comparable permanent staff in the client\u2019s company (equal pay\/equal treatment principle) was introduced by law and the bargaining agents were granted the right to regulate the specifics of the temporary employment sector by negotiation.<br \/>This has happened in the meantime. iGZ, for example, has made a deal with the wage committee for temporary employment of all individual trade unions of the Confederation of German Trade Unions (DGB), which defines balanced work conditions for all parties. With the further A\u00dcG reform in April 2011, necessary adaptions to the EU Directive Temporary Work, a generally binding minimum wage level were introduced as well as the so-called \u201crevolving door effect\u201d was eliminated, so that temporary employment cannot be abused for wage dumping.<\/p>\n<p><strong>Modern service<br \/><\/strong>Our globalised economy of today cannot be imagined without temporary employment. Most companies now make use of this modern service, trend: upwards. Even the acceptance of this flexible way of working has become much better especially due to the conclusion of across-the-board collective wage agreements.<\/p>\n<p><strong>Normal working relationship<br \/><\/strong>One thing is certain: Temporary employment agencies are run-of-the-mill companies. Temporary workers are run-of-the-mill workers. Other run-of-the-mill companies are dependent on the support of temporary employment agencies with their flexible temporary workers. Temporary work does not mean working temporarily, but different client assignments with no restrictions in time. Temporary employment is a three-way relationship between the temporary employment agency, the temporary worker and the client (the hirer). Temporary employment agencies assume all employer obligations, grant and pay for leave, pay social insurance contributions and tax on wages, and are also bound by all existing employment and social laws. box_shadow_vertical_tablet=\"0px\" box_shadow_blur_tablet=\"40px\" box_shadow_spread_tablet=\"0px\" z_index_tablet=\"500\"]<\/p><p>\u201eVerdammt noch mal, auch das noch\u201c, m\u00f6gen sich die amerikanischen Anw\u00e4lte Elmer L. Winter und Aaron Scheinfeld gedacht haben, als sie 1948 vergeblich versucht hatten, qualifizierten Ersatz f\u00fcr eine erkrankte Sekret\u00e4rin zu bekommen.<\/p><p>Als ihnen bewusst wurde, dass sie sicherlich nicht die Einzigen waren, die mit derartigen Problemen zu k\u00e4mpfen hatten, gr\u00fcndeten Sie noch im selben Jahr die Firma Manpower Inc. in Milwaukee, USA. Die Idee setzte sich durch und die neue Branche der modernen Zeitarbeit begann in den folgenden Jahren einen enormen Siegeszug quer durch die USA. Die unaufhaltsame Expansion in den Vereinigten Staaten setzte sich in Europa mit der Er\u00f6ffnung zweier B\u00fcros in Paris und London 1956 fort.<br \/><strong>Arbeitsnachweisgesetz<\/strong><\/p><p>Die Deutsche Geschichte der Zeitarbeit reicht in die Zeit nach dem ersten Weltkrieg zur\u00fcck. Das entgeltliche Vermitteln von Arbeitskr\u00e4ften wird erstmals durch das Arbeitsnachweisgesetz von 1922 geregelt. Teile davon werden am 16. Juli 1927 in das neue Gesetz \u00fcber Arbeitsvermittlung und Arbeitslosenversicherung, kurz AVAVG \u00fcbernommen. Eine Notverordnung des Reichspr\u00e4sidenten vom 6.Oktober 1931 b\u00fcrdet schon damals den Vermittlern die vollen Arbeitgeberpflichten auf. Durch die Herrschaft der Nationalsozialisten im Dritten Reich wurden s\u00e4mtliche Vermittlungsaktivit\u00e4ten dieser Branche am 5. November 1935 zum uneingeschr\u00e4nkten Monopol. Die damalige Zeitarbeit war damit praktisch tot.<\/p><p><strong>AVAG<\/strong><\/p><p>Erst Jahre nach Ende dieser Schreckensherrschaft, nachdem am 10.M\u00e4rz 1952 die so genannte Bundesanstalt f\u00fcr Arbeitsvermittlung und Arbeitslosenversicherung gegr\u00fcndet wurde, traten auch wieder die Regelungen des AVAVG von 1927 in Kraft. In dieser Zeit hatten die Deutschen jedoch verst\u00e4ndlicherweise andere Sorgen, als gute Ideen vergangener Zeiten aufzugreifen, weiter zu entwickeln und zu modernisieren.<\/p><p><strong>Vermittlungsmonopol<\/strong><\/p><p>Zwischenzeitlich hatte die Expansion der Zeitarbeit auch Europa eingeholt. Vorreiter der modernen Zeitarbeit in Deutschland war das schweizerische Unternehmen ADIA Interim, das im Jahre 1962 eine Niederlassung in Hamburg errichtete. Die T\u00e4tigkeit von ADIA \u2013 Interim rief alsbald, wie k\u00f6nnte es anders sein, die Bundesanstalt f\u00fcr Arbeit auf den Plan, die Ihr Vermittlungsmonopol bedroht sah und Strafantrag stellte. Der Musterprozess zog sich durch alle Instanzen. Am 4.April 1967 urteilte das Bundesverfassungsgericht in Karlsruhe: Die Ausdehnung des Arbeitsvermittlungsmonopols auf Arbeitnehmer\u00fcberlassungsvertr\u00e4ge durch \u00a7 37 AVAVG ist mit dem Grundrecht der freien Berufswahl gem\u00e4\u00df Artikel 12 GG nicht vereinbar.<\/p><p><strong>Mindestschutz<\/strong><\/p><p>Der Siegeszug der Dienstleistung \u201eZeitarbeit\u201c begann nun auch in Deutschland.Um einen sozialen Mindestschutz von Zeitarbeitnehmern zu gew\u00e4hrleisten, wie es das Bundessozialgericht in einem Urteil von 1970 verlangt hatte, wurde im Jahre 1972 das Gesetz zur Regelung der gewerbsm\u00e4\u00dfigen Arbeitnehmer\u00fcberlassung (Arbeitnehmer\u00fcberlassungsgesetz \u2013 kurz A\u00dcG) verabschiedet und trat auch in Kraft. Mit Einf\u00fchrung dieses Gesetzes verfolgte der Gesetzgeber verschiedene Ziele:<\/p><ul><li>das Betreiben von Arbeitnehmer\u00fcberlassung von einer Erlaubnis abh\u00e4ngig zu machen<\/li><li>die Arbeitnehmer\u00fcberlassung von der Arbeitsvermittlung abzugrenzen<\/li><li>die langfristige Arbeitnehmer\u00fcberlassung zu unterbinden<\/li><li>die Arbeitnehmer\u00fcberlassung staatlicher Kontrolle zu unterwerfen<\/li><li>den arbeits- und sozialversicherungsrechtlichen Schutz der Zeitarbeitnehmer zu gew\u00e4hrleisten<\/li><li>einen besonderen Schutz f\u00fcr ausl\u00e4ndische Arbeitnehmer zu garantieren.<\/li><\/ul><p><strong>Schwarze Schafe<\/strong><\/p><p>Gleichzeitig mit der Verabschiedung des A\u00dcG wurde die Bundesregierung beauftragt, alle vier Jahre \u00fcber Erfahrungen mit der Anwendung dieses Gesetzes zu berichten.Leider blieb auch diese junge, viel versprechende und moderne Branche nicht von skrupellosen Gesch\u00e4ftemachern verschont. Schwarze Schafe hielten sich nicht an Arbeitgeberpflichten und soziale Selbstverst\u00e4ndlichkeiten. Die aufgedeckten F\u00e4lle flossen in die Erfahrungsberichte der Bundesregierung ein. Hieraus resultiert das \u00dcberlassungsverbot ins Bauhauptgewerbe, denn dort wurden damals die meisten Verst\u00f6\u00dfe registriert. Am 1.Januar 1982 wurde \u201edie Arbeitnehmer\u00fcberlassung in Betriebe des Baugewerbes f\u00fcr Arbeiten, die \u00fcblicherweise von Arbeitern verrichtet werden\u201c, gesetzlich verboten. Eine hiergegen gerichtete Verfassungsklage blieb mit Urteil vom Februar 1988 erfolglos.<\/p><p><strong>\u00c4nderungen<\/strong><\/p><p>Diverse \u00c4nderungen des A\u00dcG sind seit damals erfolgt. Auch die Zeitarbeit muss sich st\u00e4ndig den sich \u00e4ndernden M\u00e4rkten und Gegebenheiten anpassen. Besonders im Zuge der \u201eHartz \u2013 Vorschl\u00e4ge\u201c sind die Rahmenbedingungen f\u00fcr die Arbeitnehmer\u00fcberlassung wesentlich ver\u00e4ndert worden. So gibt es seit dem 1. Januar 2004 keine Begrenzung der H\u00f6chst\u00fcberlassungsdauer mehr, das Synchronisationsverbot und die Wiedereinstellsperre sind aufgehoben. Parallel hierzu wurde die Gleichbehandlungspflicht der Zeitarbeitnehmerschaft mit den vergleichbaren Stammbesch\u00e4ftigten im Kundenbetrieb (Equal Pay\/Equal Treatment-Prinzip) gesetzlich eingef\u00fchrt und den Tarifpartnern einger\u00e4umt, die Besonderheiten der Zeitarbeitsbranche tariflich zu regeln.<br \/>Dies ist zwischenzeitlich geschehen. So hat der iGZ mit der Tarifgemeinschaft Zeitarbeit aller Einzelgewerkschaften beim DGB einen Abschluss get\u00e4tigt, der ausgewogene Arbeitbedingungen f\u00fcr alle Beteiligten festschreibt. Mir der weiteren A\u00dcG-Reform im April 2011 wurden notwendige Anpassungen an die EU-RL Zeitarbeit vorgenommen, eine allgemeinverbindliche Lohnunterschranke eingef\u00fchrt sowie der sog. \u201eDreht\u00fcreffekt\u201c ausgeschaltet, damit Zeitarbeit nicht zum Lohndumping missbraucht werden kann.<\/p><p><strong>Moderne Dienstleistung<\/strong><\/p><p>Aus unserer heutigen globalisierten Wirtschaft ist die Zeitarbeit nicht mehr wegzudenken. Die meisten Unternehmen nutzen diese moderne Dienstleistung mittlerweile, Tendenz steigend. Auch die Akzeptanz dieser flexiblen Arbeitsform innerhalb der Gesellschaft ist gerade auch durch den Abschluss von Fl\u00e4chentarifvertr\u00e4gen wesentlich besser geworden.<\/p><p><strong>Normalarbeitsverh\u00e4ltnis<\/strong><\/p><p>Fest steht: Zeitarbeitfirmen sind ganz normale Unternehmen. Zeitarbeitnehmer sind ganz normale Arbeitnehmer. Andere ganz normale Unternehmen sind auf die Unterst\u00fctzung von Zeitarbeitunternehmen mit Ihren flexiblen Zeitarbeitnehmern angewiesen. Zeitarbeit bedeutet nicht Arbeit auf Zeit, sondern unterschiedliche Kundeneins\u00e4tze ohne zeitliche Begrenzungen. Zeitarbeit ist ein Dreiecksverh\u00e4ltnis zwischen ZA-Unternehmen \u2013 ZA-Nehmer \u2013 Kunde (Entleiher). Zeitarbeitsunternehmen tragen s\u00e4mtliche Arbeitgeberpflichten, gew\u00e4hren und zahlen Urlaub, f\u00fchren Sozialversicherungsbeitr\u00e4ge und Lohnsteuer ab, sind auch an s\u00e4mtliche bestehenden Arbeits- und Sozialgesetze gebunden.
