A\u00dcG) \u2013 i.e. temporary employment. Among others, it lays down the following principles:<\/p>\n<ul>\n<li>Licence obligation (Sections 1-3, Section 4 and 5): Temporary employment agencies need a so-called \u201clicence to supply temporary workers\u201d, which is initially issued for a limited period and which can then, after three years, be issued for an unlimited period.<\/li>\n<\/ul>\n<ul>\n<li>Minimum wage (Section 3a): The A\u00dcG permits the establishment of a \u201cbinding minimum wage\u201d at the proposal of the parties to the collective wage agreement by the Federal Employment Agency. Use was made of this regulation included ex post for the first time on 01 January 2012. There has been a minimum wage for temporary employment ever since.<\/li>\n<\/ul>\n<ul>\n<li>Collective wage exemption clause (Section10, Para. 4): In principle, a temporary worker must be treated (and paid) exactly the same as a comparable worker in the client company. Under the application of a collective wage agreement for temporary work, this can be deviated from. \u00dcberlassung von Arbeitnehmern durch Arbeitgeber (Unternehmen) \u201eim Rahmen ihrer Wirtschaftlichen T\u00e4tigkeit zur Arbeitsleistung\u201c (\u00a71, Abs. 1 A\u00dcG) \u2013 also die Zeitarbeit. Es legt unter anderem folgende Grunds\u00e4tze fest:<\/p><ul><li>Erlaubnispflicht (\u00a71-\u00a73, \u00a74-\u00a75): Zeitarbeitsunternehmen ben\u00f6tigen eine sog. \u201eArbeitnehmer\u00fcberlassungserlaubnis\u201c, die zun\u00e4chst befristet wird und nach drei Jahren schlie\u00dflich unbefristet erteilt werden kann.<\/li><li>Mindestlohn (\u00a7 3a): Das A\u00dcG l\u00e4sst die Einrichtung einer \u201everbindlichen Lohnuntergrenze\u201c auf Vorschlag der Tarifvertragsparteien durch das Bundesarbeitsministerium zu. Von dieser nachtr\u00e4glich eingef\u00fcgten Regelung wurde am 1.1.2012 erstmalig Gebrauch gemacht. Seither gibt es einen Mindestlohn f\u00fcr die Zeitarbeit.<\/li><li>Tarif\u00f6ffnungsklausel (\u00a710, Abs. 4): Grunds\u00e4tzlich muss ein Zeitarbeitnehmer genauso behandelt (und bezahlt) werden, wie ein vergleichbarer Arbeitnehmer im Einsatzbetrieb. Hiervon kann durch Anwendung eines Tarifvertrages f\u00fcr die Zeitarbeit abgewichen werden.
